Welcome back! In our last post, we introduced the first set of conditions that you should have on your home offer whenever possible. We also talked about when it might be necessary to waive it, as well as the Realtor®’s role in protecting you during this critical time.

Appraisal Condition

The appraisal condition ensures that the home is appraised for at least the purchase price. If the appraisal comes in lower than expected, the buyer has the right to renegotiate the price or walk away from the deal.

How it Protects the Buyer

This condition offers protection against market volatility and helps ensure that you don’t overpay for the property. If the home is appraised for less than the agreed upon price, the buyer has an out to either adjust the deal or cancel it.

Again, this is a very real situation that we have dealt with often. Not long ago, we sold a home where the buyer did not get an appraisal sufficient to the value of the home. Without this condition, the buyer had to come up with extra money for their down payment, which they were fortunately able to borrow from family members. Obviously, Weeks Group did not represent this buyer, because we would not have allowed this to happen!

When to Waive

Waiving the appraisal condition can be a way to make your offer more competitive, especially in a multiple-offer situation. However, it could also leave you on the hook for paying more than the home is worth.

This condition gives buyers the opportunity to back out of the deal if they cannot sell their current home before closing.

It protects you from being financially stretched by requiring you to manage two properties at once. Without this condition, you may end up with the financial burden of two mortgages or having to close before your current home is sold.

It has become more common in current market conditions (this may change) to have these offers accepted by sellers. However, there is a lot of work to expertly prepare the story to the sellers so they feel comfortable accepting an offer that may not complete if your home doesn’t sell in an agreed timeline.

In a hot market, sellers may be hesitant to wait for you to sell your property. In this case, waiving this condition could give your offer a better chance of being accepted.
